Yes — even if you have a living trust, you still need a will in Florida. A pour-over will ensures that any assets not transferred into your trust during your lifetime are captured and directed into it upon your death. Without a will, those assets could pass through Florida's intestate laws rather than according to your wishes.
To qualify for Florida Medicaid long-term care, you must meet both medical and financial eligibility requirements. Financially, you generally cannot have more than $2,000 in countable assets and your income must be under $2,742/month. However, with proper Medicaid planning, many families can still qualify even if they exceed these limits — while protecting significant assets.
Certain assets are exempt from Medicaid calculations in Florida, including your primary home (if you intend to return or a spouse lives there), one vehicle, personal belongings, prepaid burial plans, and term life insurance. A community spouse can also keep up to $148,620 in countable assets. Proper planning can protect significantly more.
